This Acceptable Use Policy ("AUP") applies to access to and use of the MadeBy Service and is incorporated into the MadeBy Terms of Use and each Subscription Agreement that references it. Defined terms have the meanings given in the Terms. You may not use the Service, or help another person use it, in a way prohibited by this AUP.
1. Illegal, harmful, or rights-violating use
You may not use the Service to:
- violate applicable law, regulation, sanctions, or export controls;
- facilitate fraud, theft, deception, cybercrime, money laundering, or evasion of legal obligations;
- create, upload, distribute, or request unlawful, defamatory, harassing, threatening, exploitative, or discriminatory material;
- infringe or misappropriate privacy, publicity, confidentiality, intellectual-property, or other rights;
- impersonate another person or misrepresent authorization, identity, affiliation, or the source or reliability of an Output; or
- monitor, profile, or make decisions about a person in violation of law or without required notice, authority, and human review.
2. Restricted Data
You may not submit Restricted Data as defined in the Terms, including PHI or identifiable health data; government identification numbers; financial credentials or full payment-card data; authentication secrets; biometric or genetic identifiers; precise geolocation; children's data; sensitive personal traits; sensitive applicant, employment, or human-resources records; personal information not reasonably necessary for a legitimate business purpose; or other data requiring heightened safeguards that MadeBy has not expressly approved. Ordinary business and professional information and incidental workplace information in meeting notes are permitted.
This restriction applies to documents, prompts, chats, recordings, transcripts, imports, and any other Customer Data. Masking a filename or asking the AI not to repeat the information does not make Restricted Data permitted.
3. Security, access, and interference
You may not:
- gain or attempt to gain unauthorized access to an account, Workspace, Knowledge Layer, Group, Space, chat, system, or data;
- share an account, access token, invitation link, or authentication session with an unauthorized person;
- upload malware or harmful code, or use content intended to compromise or manipulate the Service;
- probe, scan, or test vulnerabilities without MadeBy's prior written authorization;
- interfere with the Service, evade usage or spend limits, impose an unreasonable load, or use automated means to scrape or extract data except through an authorized interface;
- bypass isolation, permissions, moderation, retrieval restrictions, or other security controls; or
- use production Customer Data in an unauthorized test, demonstration, benchmark, or external tool.
4. AI and platform safeguards
You may not:
- attempt to extract, reconstruct, evade, override, or defeat non-public MadeBy platform instructions, system prompts, safety controls, or security logic;
- represent an AI Output as verified, complete, or professionally approved when it is not;
- use an Output as the sole basis for a decision affecting employment, housing, credit, insurance, healthcare, education, access to essential services, legal rights, or another similarly significant interest;
- use the Service to develop or distribute malware, phishing, credential theft, or instructions for unauthorized system access; or
- use MadeBy Technology, non-public instructions, a Knowledge Layer, protected source material, or systematic collections of Outputs to train, fine-tune, distill, evaluate, or improve a model, service, dataset, or knowledge product without MadeBy's prior written approval and all permissions required from the applicable rights holders. MadeBy itself does not use Customer Data or Outputs for model training.
5. Distillation and systematic extraction
Ordinary authorized use of individual Outputs in the Customer's business is permitted. You may not, however, use automated, repetitive, coordinated, or high-volume prompts, accounts, scripts, exports, or manual workflows to:
- reconstruct, approximate, reveal, or create a substitute for MadeBy Technology, non-public instructions, a Knowledge Layer, protected methodology, source collection, or other confidential or proprietary material;
- build a competing or substitutable chatbot, model, service, dataset, playbook, or knowledge product from those materials or systematic Outputs;
- evade usage limits or distribute a coordinated extraction task across accounts or people; or
- benchmark or probe the Service in a way designed to infer protected instructions, sources, retrieval behavior, or safeguards.
You also may not publish comparative or performance benchmarks of the Service without MadeBy's prior written approval. Ordinary internal evaluation that does not involve Distillation or an AUP violation is permitted.
MadeBy may consider frequency, volume, coordination, automation, similarity of requests, attempted coverage, and the apparent purpose of a workflow. No single factor by itself makes normal business use prohibited.
6. Commercial and intellectual-property restrictions
Except as a Subscription Agreement permits, you may not:
- sell, sublicense, timeshare, lease, or provide the Service to a third party;
- copy, modify, reverse engineer, decompile, or attempt to discover non-public source code, algorithms, models, prompts, or underlying components, except where law prohibits this restriction;
- remove proprietary notices; or
- use MadeBy branding, documentation, or technology in a way that suggests sponsorship or authorization that MadeBy has not granted.
7. Enforcement
MadeBy may investigate suspected violations and preserve relevant evidence. MadeBy may remove or restrict content, limit a feature, suspend access, or terminate an account when reasonably necessary to stop a violation, protect the Service or others, comply with law, or prevent material harm. Where appropriate and safe, MadeBy will notify the Customer and provide a reasonable opportunity to cure. Serious or repeated violations, illegal conduct, security attacks, or submission of Restricted Data may result in immediate action.
Customers are responsible for their users and for promptly reporting suspected violations to legal@AIMadeBy.com.
8. Changes
MadeBy may update this AUP to address new risks, laws, or Service capabilities. A material change requires the notice and re-acceptance process stated in the Terms or Subscription Agreement. A non-material change may take effect after MadeBy posts the updated AUP and revises its effective or last-updated date, without requiring re-acceptance.
